Museum of Ice Cream sued after man breaks ankle in sprinkle pit

New York City’s Museum of Ice Cream is facing a lawsuit from a man who says he broke his ankle after leaping into the sprinkle pool, which he claims was deceptively advertised.

Jeremy Shorr filed the lawsuit on Wednesday in Manhattan, arguing the museum was negligent in failing to warn visitors about the dangers of jumping into the sprinkle pool, a ball-pit-like installation filled with giant plastic sprinkles.

Shorr says he was visiting the museum’s SoHo location with his daughter when the incident occurred on March 31, 2023.

He claims the museum referenced the sprinkle pit on its website and social media posts, encouraging patrons to “dive into fun” and “jump in,” creating what he called a false expectation that he could take the promotional material literally.

After jumping into the pit and badly injuring his ankle, Shorr required surgery, physical therapy and diagnostic testing, he says. He’s now seeking unspecified damages to cover his expenses.

Last year, the museum’s main Instagram page reposted a visitor’s TikTok, which shows them attempting to cannon-ball jump from a diving board into the sprinkle pool, and then bouncing off the surface.

Another promotional video shows a man leaping off of the same type of diving board, but doesn’t show the aftermath.

The museum, known for its ice cream-themed installations and all-you-can-eat offerings, has four locations across the United States — in NYC, Austin, Chicago and Miami — and one overseas in Singapore.
